The Ministerial Regulations


Since December 29, 2007 Thailand’s New Building Inspection Law is effective.

Types of Inspection:


General Inspection will be carried out every 5 years.
Annual Inspection as planned by the Building Inspector.


What en who is affected by the law?


Owners of the following types of building are required to submit the building inspection report:
  • High-rise buildings of equal or more than 23 meters in height.
  • Special large-scale buildings containing equal or more than 10,000 sq m of total gross area.
  • Public buildings containing equal or more than 1,000 sq m of total floor area where people can utilize or where can contain equal or more than 500 people in total.
  • Buildings where any kind of entertainment is performed.
  • Hotels contain equal or more than 80 rooms in total.
  • Buildings containing equal or more than 200 sq m of gross area where services are provided to public as defined in the place of service providing-related statutory.
  • Condominiums or residential buildings containing equal or more than 2,000 sq m of total gross area.
    Exception is allowed for condominiums or residential buildings containing equal or less than 5,000 sq m of total gross area, to submit the report within Oct 24, 2012.
    Exception is allowed for condominiums or residential buildings containing less than 5,000 sq m of total gross area, to submit the report within Oct 24, 2010.
  • Factories which have more than one floor and contain equal or more than 5,000 sq m of total gross area.
  • Signboards or constructions for erection of signboard that have equal or more than 15 meters in height, measured from the ground or contain equal or more than 50 sq m of area. Or signboards erected on the roof or roof deck of a building or any other part of a building that contain equal or more than 25 sq m of area.

Duty of the Building Owners:


  1. To appoint a building inspector registered with the Building Control
    Commission.
  2. To provide plans and drawings relating to the structural and architectural
    design and construction, and installation of the building services and facilities.
  3. To prepare relevant documents, and collaborate in planning and conducting the building inspection with the Building Inspector
  4. To carry out improvement and rectification work as recommended in the report of the Building Inspector.
  5. In the event that the Building inspector advises that a specialist is needed to be appointed for each discipline in order to perform technical inspection and to report on a specific discipline, the building owner will have to appoint these specialists.
  6. To submit to the local official the report that has been prepared and certified by the Building Inspector.
  7. To conduct building inspection and maintenance as planned by the Building Inspector.

Incompliance is subject to imprisonment for not more than 3 months or a fine of not more than Baht 60,000, or the imprisonment together with the fine.


Building Inspectors


Professional engineers or architects who are qualified to perform the building control, and have been trained and passed examination for technical competency conducted by a licensed institution, and have registered as a Building Inspector with the Building Control Commission.

Be aware many building owners are unable to complete the inspection in time due to a shortage of qualified inspectors. Therefore plan your inspections carefully.
