The Thai property market and specific the Pattaya Jomtien market seems to be subject without a tangible outcome when reading publications be it on- or offline. There is much speculation, opinion, tension and contradiction.
Just a few facts: The property market is not slow. The saturation point is not reached and no, Malaysia will not convince anybody with their 10 year homeowner visas to buy a house in Kuala Lumpur instead of lively Pattaya, because the people of Kuala Lumpur keep coming to Pattaya whenever they can. Malaysia and Thailand cannot be compared, they are simply too different.
The Thai economy will expand at a faster pace in 2008 and the property sector will benefit from it. The political turmoil is over.
Now we are back to normal, the conditions improved. The property market is highly dependent on the overall economy and when looking around we see activity everywhere. New shopping centers open their doors, new condominium buildings are rising, new resorts are in the process of being built and new joint ventures are started. There is high activity in the commercial as well as the residential real estate market.
Despite the high fuel prices and the political stress the real estate market in Bangkok for example produced much better results than it was predicted for 2007. Investors were not packing in and left when the military took over, no, quite the opposite, they were lining up as nothing had happened. Who turns around on a bargain and who leaves now voluntarily this huge market potential that Thailand inhibits, with 62 million people and one of the best performing of the emerging markets behind? Nobody!

The seaside suburb of Bangkok is called Pattaya and Bangkok grows at a rapid speed. Pattaya benefits from it as it did in the past, so it will in the future. Beyond this, the new international airport of Bangkok is just an hour away, the new motorway will still be crossing through Pattaya and Jomtien and possibly most importantly, there seems to be some clarification on the horizon regarding the Foreign Business Act.
All Farangs (foreigners) are more or less interested in this regulating law which was amended in April 2007 by the militaries after the coup. The Foreign Business Act restricts foreigners activities to a set of rules listing what is allowed and disallowed for a foreigner in Thailand. Thai companies always were able to buy land without hindrance, bypassing for example the 49% quota of foreign ownership for condominiums, or to buy company land.
The amendment states:

This regulation is in the form of an instruction to all Land Departments.
It applies to all companies or partnerships where there are any foreign shareholders, directors or partners:
Where it is reasonable to believe that a Thai is holding shares on behalf of a foreigner, then the Land Department may investigate their income background, current employment and salary and call for evidence on such matters. If a loan was used in connection with the purchase, evidence of the loan can be called for. If after investigation it appears that the transfer of land was intended to avoid the law, or a person is buying the land for the benefit of a foreigner, then the case may be referred to the Land Department in Bangkok for further consideration.
Fact is that the Thai Baht is strong mainly because of the investors coming from foreign countries pumping their capital into Thailand They bring foreign currencies into the country in billions. For example Hong Kong Real Estate International just invested the sum of 18-billion Baht in residential developments. Concord Property Group Hong Kong invests into an integrated property development project which is worth 40-billion Baht in the Pinklao area. Conclusion: this amendment will be clarified and the government will most likely resolve this situation. Thais would be hit a lot harder than the foreigners if this amendment would be actually exercised as we read it above. The military made a whole scale of laws that were often eliminated again after proving to have a devastating effect on the economy, some laws were recalled even within 30 days.
The 'status quo' will remain, investor confidence in the kingdom will be further encouraged as the economy and financial situation of Thailand depends on it. We have a win win situation this makes the underlying structure for investments sound .
